Legalized simply means it is not a criminal offense. Employers can still require you to be drug free, and can still require drug testing.

You comply with all that they ask you to do, if you are drug free what is your problem? otherwise refusal will be seen as you having something to hide, and you could lose your child.

Any charges can be dropped give the right circumstances. Will your marijuana charges be dropped? We have no way to know. But your new unresolved assault case makes it very unlikely.
